I was told that the firm would return the deposit if the work promised wasnWt carried out and that the firm was a member of the Glass and Glazing Federation. The firm has now gone into liquidation and the Federation wonWt return our cash. It's offered a voucher to set off the costs of using another firm. Do we have to accept this? When a firm becomes insolvent, the law sets out the order in which creditors, of which you are one, are paid. Persons with priority are those with some security, like a mortgage, and the Inland Revenue. Bottom of the list are those described as unsecured creditors. more > Live At 5 Guide 120 Five Live 129 Five Live Stars Sport TV Guide

Ask whether there is likely to be enough money left over to pay unsecured creditors. If not, ask whether deposit funds were paid into a special account. A court case a while back involving a mail order company, said that where deposit moneys were paid into a special account with the express purpose that they were returned in the event of insolvency, that money belonged to the creditors and not the liquidator. more > Live At 5 Guide 120 Five Live 129 Five Live Stars Sport TV Guide

It sounds like a measure of good faith on the part of the Federation to protect the good name of its industry. Telephone firms on its list to find out what they will charge. If it's too much, try contacting other firms and if their costs are less, see if the Federation will allow for this. I canWt see the Federation has an obligation to pay you a sum of money equal to your deposit. Tony Nayager start > Live At 5 Guide 120 Five Live 129 Five Live Stars Sport TV Guide
